Be Held UGC Terms and Conditions

 

Be Held Ltd may, on certain occasions, reach out to a wide spectrum of social media users to gain their permission to feature engaging content on our websites, social media channels and assorted promotional materials. The reason you are reading this is because Be Held has requested your permission and authorisation to use your own social media content as stated above.

 

You can choose to allow us to use your social media content, also referred to as ‘User Generated Content’ (UGC), by replying with the hashtag #YESBeHeldOfficial

By so doing you are agreeing to our Terms of Use and the Be Held Privacy Policy.

 

We reserve our right to change these Terms of Use without any advance notice by posting a revised Terms of Use. You should always remember to review these Terms of Use every time you grant authorisation or permission for Be Held to feature your own personal UGC.

You hereby grant Be Held a worldwide, royalty-free, irrevocable, perpetual, completely-paid, right to use your personal User Generated Content in any such manner as will be determined solely at Be Held’s discretion. This includes, but is in no way limited to, the Be Held webpages and social media pages that we operate. Also, in promotional advertising and emails, and other such promotional, advertising and marketing, marketing events and initiatives, and in any other form of media currently, or known hereafter. To do this, Be Held may utilise, reproduce, display, transmit, distribute and create their own derivative works either from, or by combining with other materials, or by altering as well as editing your own personal UGC, at their sole discretion and in any such manner, without any obligation to you whatsoever.

You also hereby agree and grant Be Held the right to utilise the following: your username, real name, likeness and image, as well as any descriptions of you, any locations or any other identifying information, including but in no way solely limited to your voice, in connection with any usage of your User Generated Content.

You hereby agree and represent and warrant that (i) you are solely responsible for your User Generated Content (UGC), (ii) you own all rights in and to your User Generated Content and/or have obtained appropriate rights and permissions from any and all other persons and/or entities who own, manage or otherwise claim any rights with respect to such User Generated Content, (iii) you are 18 years of age or older, (iv) Be Held’s use of your User Generated Content as described herein will not violate the rights, including but not limited to copyright, trademark, patent, trade secret, privacy, publicity, moral, proprietary or other rights, of any third party, or any law, rule or regulation, and (v) the User Generated Content is not libellous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, or offensive or otherwise unlawful, (vi) does not link to any media or executable file.

For your information, when Be Held chooses and publishes any submitted User Generated Content, it does so at its absolute discretion. For the avoidance of doubt, Be Held is under no obligation to use any of the User Generated Content submitted. Be Held reserves the right to remove the User Generated Content from any or all of our social channels, websites or marketing materials at any time, for any reason.

You hereby release, discharge and agree to hold Be Held, and any person acting on their behalf, harmless from any liability related in any way to Be Held’s use of your User Generated Content.

If you believe that any User Generated Content used by Be Held is inappropriate, offensive or is in some way violating someone’s legal rights (for example, a trademark or infringement of copyright) then you can report the photo by sending an email to hello@BeHeld.com
